A LEGISLATIVE OR GOVERNMENTAL CHANGE CREATES A NEGATIVE IMPACT ON THE PROGRAM 2. ONCE THE TOTAL OF THE SCHOOL'S RESERVE FUNDS HAS REACHED AN AMOUNT OF OVER 50% OF THE AVERAGE OF DAY SCHOOL'S PRECEDING THREE YEARS OF EITC/OSTC CONTRIBUTIONS, SCHOOL MAY DISTRIBUTE FUNDS TO STUDENTS WHO ARE PENNSYLVANIA RESIDENTS ACCORDING TO DAY SCHOOL'S CRITERIA FOR DETERMINING FINANCIAL NEED, OR ACCORDING TO THE STATE'S CRITERIA ALREADY FOLLOWED BY THE FOUNDATION, AT THE SCHOOL DISCRETION.RESERVE FUNDS ARE TO BE HELD AND INVESTED EITHER BY THE DAY SCHOOL OR BY THE FOUNDATION UNTIL A TRIGGERING EVENT IS MET.
