To advocate, negotiate, and litigate to protect and restore the south florida ecosystem.

About

Provide legal services to protect natural resources that directly affect communities and to represent advocacy groups before governmental agencies to protect natural resources with a focus on America's Everglades. Represent the public interest in environmental and land use matters, working with national, state, and local environmental and conservation groups including land use, wetlands permitting, endangered species, public lands, and sustainable energy development with a focus on America's Everglades. In 2018, ELC was involved in two cases in litigation, one as an amicus curiae and one as a respondent: 1. City of West Palm Beach v. Palm Beach County, Florida Department of Transportation, and South Florida Water Management District, Case No. 4D17-1412. ELC was given leave to file an amicus curiae ("friend of the court") brief in a case before the 4th District Court of Appeals of Florida, in which the City of West Palm Beach appealed an order by the South Florida Water Management District granting an environmental resource permit to Palm Beach County for the proposed extension of State Road 7. The proposed road extension threatened the water quality of Grassy Waters Preserve and endangered snail kite habitat. Our appellate brief addressed the lower tribunal's misinterpretation of the level of harm allowed under the state narrative water quality standard, an interpretation which would have had significant, negative implications for the way in which various Clean Water Act programs could be administered in the state. The 4th DCA decided in our favor in August 2018. We did not seek (and thus did not recover) fees. 2. Everglades Law Center, Inc., Maggy Hurchalla and Donna Melzer v. South Florida Water Management District, 4D18-1220 (Lower Tribunal No. 432017CA001098). ELC sought public records related to the South Florida Water Management District's behind- closed-doors decision to settle a case involving an environmental activist and a large development project. The district filed a declaratory judgment action in circuit court, asking for a declaration that it need not disclose a transcript of the board session at which it made the decision to settle the case. ELC retained counsel to represent it in this action filed against it as a respondent. The circuit court ruled in the district's favor, and ELC appealed to the 4th District Court of Appeal. Although this is not a case ELC brought as a public interest law firm, its defense seeks to vindicate the public's right to have access to the basis of government decision-making related to environmental protection and the expenditure of public funds. ELC has not sought fees, because it is not representing clients in the action/appeal.
